Terms of Service

Crewbase connects NCAA-verified aviation professionals with Nigerian operators. These terms set out what the service does, what it deliberately does not do, what we expect from both sides, and how disagreements get resolved.

1This agreement

These terms are a contract between you and registered company name, a company incorporated in Nigeria with registration number RC number, registered office registered address (“Crewbase”, “we”, “us”). They govern your use of crewbase.africa, app.crewbase.africa and any Crewbase mobile application.

You accept them when you create an account or sign in. If you are doing so for a company, you confirm you are authorised to bind it, and “you” means both you and that company. Acceptance by clicking is a valid signature under Nigerian law, and our records of it are admissible evidence.

Our Privacy Policy forms part of this agreement. If the two conflict on a data protection question, the Privacy Policy prevails.

2Definitions

Defined terms used in these terms

EngagementAny employment, contract, assignment or other work arrangement between an operator and a professional.

Nig.CARsThe Nigeria Civil Aviation Regulations, as amended.

3Who may use Crewbase

  • You must be at least 18 years old and able to enter a binding contract.
  • You must give accurate registration details and keep them current.
  • An operator account may only be opened by, or on behalf of, a real aviation business. We may ask for evidence of it.
  • You must not be barred from receiving our services under any law that applies to you, and you must not have had a Crewbase account terminated for cause.

4What Crewbase is — and is not

In short — we verify licences and let operators find the people who hold them. We do not employ anyone, place anyone, or take a cut of any engagement.

4.1 What we do

Crewbase is a discovery and verification platform. We check aviation credentials against the issuing authority’s records and publish the outcome, so that operators can find professionals whose licences have been checked, and professionals can be found without touting for work.

4.2 What we are not

We are not an employer, not an employment business, not a labour supplier, and not a party to any engagement that follows an introduction made here. In particular:

  • We do not recruit, select, interview, screen for suitability or place anyone on behalf of an employer. Operators search for themselves and decide for themselves.
  • We do not negotiate, set or influence rates, hours, duties or terms of engagement. Those are agreed directly between operator and professional, off the platform.
  • We charge no fee for any placement, introduction or engagement, and take no percentage of anything a professional earns.
  • We charge professionals nothing, ever. Our only revenue is an operator subscription for access to the platform, which is payable whether or not anyone is engaged.
  • We do not guarantee that a professional will be offered work, that an operator will find crew, or that any engagement will be performed.

Any engagement is a contract between the operator and the professional alone. Neither of them may hold us responsible for the other’s performance, payment, conduct or decisions.

4.3 Your own obligations remain yours

Nothing on Crewbase relieves an operator of its duties under the Nig.CARs, its operations manual, or its approvals, and nothing relieves a professional of the duty to hold and maintain a valid licence, rating and medical for the work they accept. Each of you is responsible for your own regulatory compliance, tax, insurance, work authorisation and immigration status.

5Your account

  • Sign-in is a one-time code sent to your email, or an optional Google sign-in. There is no password.
  • Your account is personal to you. Do not share your sign-in codes or let anyone else use your account. Anything done through it is treated as done by you.
  • Tell us at once, at legal@crewbase.africa, if you believe someone else has access to your account.
  • One professional account per person. One workspace per operator, unless we agree otherwise in writing.
  • An operator is responsible for everything its team members do in its workspace, including contact reveals they spend and requests they post. Removing a team member is the operator’s job, and should be done the day they leave.

6What verification means

In short — a verified badge means a person checked that licence against the issuing authority on a given date. It is not a judgement of competence, and it does not stay true by itself.

A verified badge means that a member of our team compared the credential you submitted with the issuing authority’s record, and found it genuine and current at the date of that review, which we publish alongside the badge.

It is not, and must not be treated as, a check of:

  • Flight hours. Total, pilot-in-command, night, instrument and hours-on-type are self-reported by the professional and labelled as self-reported everywhere they appear. NCAA verifies licences, not logbooks.
  • Competence, recency, currency of training, or fitness to operate any particular flight or task.
  • Medical fitness beyond the existence and validity dates of a certificate. We record no clinical content.
  • Anything that changed after the review date. A licence can lapse, be suspended or be revoked the day after we verified it.
  • Character, employment history, references, right to work, or anything a background check would cover. We do none of that.

Operators remain fully responsible for their own pre-employment, pre-engagement and pre-flight checks, and must independently satisfy themselves that any professional holds valid, current entitlements for the work assigned. Where the Nig.CARs or an operator’s approvals require the operator to hold and check crew records, Crewbase does not discharge that duty and must not be relied on as if it did.

We may re-check, suspend or withdraw a verification at any time, and will tell the professional why. Verification is a service we perform with reasonable skill and care — it is not a warranty.

7If you are a professional

  • Submit only your own credentials, and only genuine, unaltered documents. Submitting another person’s licence, or a document that has been tampered with, will end your account and may be reported to the NCAA and to the police.
  • Keep your dossier true. Availability, type ratings and logbook figures are what operators rely on when they decide whether to call you. Deliberately inflating them is a breach of these terms.
  • Tell us when something lapses. If a licence, rating or medical expires, is suspended or is withdrawn, update your dossier promptly. A verified badge you know to be stale must not be left standing.
  • Ad-hoc work requires you to declare that you are contractually free to accept it. Many Nigerian pilots are training-bonded to the airline that paid for their type rating. We cannot police private bonds and we do not try — but the declaration you make is recorded with your response and shown to the operator, and making a false one is your risk, not ours.
  • When you respond to a request, the operator sees your dossier. If you apply to a recruitment or training post you become visible to that operator even if you hold no verified credential yet.
  • You deal with operators directly. Rates, terms, contracts and payment are between you and them. If an operator does not pay you, tell us — we can act on their account, but we cannot pay you ourselves.
  • Crewbase is free for professionals, and we will not introduce a charge to you without at least 60 days’ notice and the chance to leave first.

8If you are an operator

  • Post honestly. A request must describe work you genuinely intend to fill, with the credentials you genuinely require. Do not post to collect dossiers, to test the market, or to advertise something else.
  • Do your own checks. See clause 6. Verification is a starting point, not a substitute for your regulatory obligations.
  • Treat applicants lawfully. Do not use Crewbase to discriminate on any ground prohibited by Nigerian law, and do not ask professionals for information you are not entitled to.
  • You are a data controller in your own right for everything you take off the platform — contact details, dossiers, applicant lists, your own private notes. Your obligations under the Nigeria Data Protection Act 2023 apply to that data from the moment you receive it.
  • Your team acts for you. You are responsible for their conduct in your workspace, for the reveals they spend, and for removing them when they leave.
  • Keep your subscription in good standing. Unpaid periods pause posting and contact reveals — see clause 14.

9Contact details and how they may be used

A contact reveal buys you one thing: permission to approach that professional about the work you found them for. When you spend one, a permanent record is written identifying your company, the team member who acted and the time, and the professional is told.

You must not:

  • Use revealed details for anything other than discussing the specific work you had in mind.
  • Add a professional to a mailing list, newsletter, WhatsApp broadcast or marketing campaign.
  • Pass revealed details to another company, including a group company or an agency acting for you, or sell them.
  • Build, export or maintain a separate database of Crewbase professionals.
  • Keep contact details after they have served their purpose, beyond what your own retention policy and the NDPA allow.

Misuse of contact details is the fastest way to lose an account here, and we will say so plainly to the professional affected. It may also be an offence under the NDPA for which you, not we, are liable.

10AOG and urgent work

The AOG channel exists to reach available, verified, correctly rated people quickly when an aircraft is on the ground. Because it is urgent, three things need saying plainly:

  • Alerts are delivered on a best-efforts basis. Email, SMS and push all depend on networks and providers outside our control. We do not guarantee delivery, delivery within any time, or that anyone will respond.
  • A response is an expression of availability, not a binding acceptance. The engagement is formed between operator and professional, on their own terms.
  • Urgency never displaces safety or regulation. An operator must not use a Crewbase alert to shortcut a check it is required to perform, and a professional must not accept work they are not current, rested or entitled to perform. If the two conflict, the regulation wins and we will support the person who said no.

11Your content and our platform

11.1 What you provide

You keep ownership of everything you upload — documents, dossier text, company details, request descriptions, notes. You grant us a non-exclusive, royalty-free licence to host, store, reproduce and display it strictly as needed to operate the platform, to verify credentials, and to show it to the people described in the Privacy Policy. That licence ends when you delete the content or close your account, except where clause 13 of the Privacy Policy requires us to keep a record.

You confirm that you have the right to provide what you provide, and that it does not infringe anyone else’s rights.

11.2 What is ours

The platform, its software, design, the Crewbase name and logo, and our aggregated and anonymised statistics are ours and stay ours. Nothing in these terms transfers any of it to you. You may not copy, adapt, reverse engineer or create derivative works from the platform.

11.3 Feedback

If you send us an idea for improving Crewbase, we may use it freely and without obligation. We would rather you told us than held it back for fear of this clause.

12Acceptable use

You must not:

  • Scrape, crawl, bulk-download or systematically extract data from Crewbase, by any means, automated or manual.
  • Access the platform other than through the interfaces we provide, or attempt to bypass any technical restriction, rate limit or plan entitlement.
  • Probe, scan or test the security of the platform without our prior written permission, or attempt to access data belonging to anyone else.
  • Impersonate another person or company, or misrepresent your affiliation with one.
  • Upload malware, or anything unlawful, defamatory, harassing or obscene.
  • Resell, sublicense or share your access, or use one workspace to serve multiple companies.
  • Use Crewbase to build a competing verification or crew-sourcing product.

Responsible security research is welcome. Tell us first at legal@crewbase.africa, stay within what you need to demonstrate the issue, and we will not pursue you for it.

13Plans, fees and payment

Crewbase is free for professionals. Operators subscribe. Plans are billed monthly in Nigerian Naira and collected by Paystack; we never see your card details.

Entitlements are enforced by the platform, and the billing page always shows the current position. Prices are exclusive of VAT, which is added at the prevailing rate (currently 7.5%) where it applies. You are responsible for any other tax arising on your side. Monthly reveal allowances do not roll over.

14Renewal, cancellation and refunds

  • Subscriptions renew automatically each month until cancelled. We will remind you before each renewal.
  • You may cancel at any time from the billing page. Cancellation takes effect at the end of the period you have already paid for, and you keep full access until then.
  • If a payment fails we mark the account past due, and posting and contact reveals pause. We do not delete your data, close your open requests, or lose your shortlists. Settle the payment and everything resumes.
  • First-time subscribers may cancel within 7 days of their first payment and receive a full refund, provided no contact reveal has been spent and no request has been posted on the plan.
  • Otherwise, part-months are not refunded — the plan is prepaid and the access was available to you. We will refund where we have failed to provide the service, where we terminate your account without cause, or where Nigerian law requires it.
  • Nothing here limits your rights under the Federal Competition and Consumer Protection Act 2018.

Refund requests go to billing@crewbase.africa. We will answer within 7 days and pay approved refunds to the original payment method within 14 days.

15Changes to plans and prices

We may change prices or what a plan includes. We will give you at least 30 days’ notice by email, and the change takes effect at your next renewal after that notice. If you do not want to continue, cancel before it takes effect and you will not be charged the new price.

We will not reduce what a plan includes during a period you have already paid for. If we withdraw a plan entirely, you may stay on it until the end of your paid period and we will offer you the closest equivalent.

16Suspension and termination

You may stop using Crewbase and close your account at any time — see clause 17 of the Privacy Policy for how deletion currently works.

We may suspend or terminate an account where:

  • A credential is fraudulent, altered, or not the account holder’s own.
  • Contact details have been misused, exported or passed on.
  • Requests are posted in bad faith.
  • Clause 12 has been breached.
  • A subscription is unpaid after we have asked for payment.
  • We are required to by law, a regulator or a court.

Except where the breach is serious or we are compelled to act at once, we will warn you first and give you a reasonable chance to put it right. Where we suspend or terminate, we will tell you why — plainly, and in writing. You may appeal to legal@crewbase.africa and a person who was not involved in the original decision will review it.

On termination your right to use the platform ends immediately. Clauses 11.2, 18, 19, 20, 21 and 24 survive, along with any payment already due.

17Availability and support

We aim to keep Crewbase available at all times and to give reasonable notice of planned maintenance, but we do not promise uninterrupted service and we offer no service level agreement unless we have signed one with you separately.

Support is by email — help@crewbase.africa for professionals and Starter operators, with priority handling for Pro and dedicated support for Enterprise. We answer during Nigerian business hours.

18Disclaimers

Except as expressly stated in these terms and as far as the law allows, Crewbase is provided as is. We do not warrant that the platform will be error-free, that alerts will arrive, that search results will be complete, or that any particular outcome will follow from using it.

In particular, we give no warranty as to:

  • The accuracy of anything a user tells us — logbook hours, availability, ad-hoc eligibility, company details, or the terms of a posted request.
  • The continuing validity of any credential after its verification date.
  • The conduct, solvency, honesty or performance of any operator or any professional.
  • The outcome of any engagement, including whether it is offered, accepted, performed or paid for.

Nothing in this clause excludes any warranty or condition that Nigerian law does not permit us to exclude, including under the Federal Competition and Consumer Protection Act 2018.

19Limitation of liability

In short — we accept responsibility for our own failures, capped at what you paid us. We do not accept responsibility for what an operator or a professional does after we introduce them, or for the cost of a grounded aircraft.

19.1 What we never exclude

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for a deliberate breach of the Nigeria Data Protection Act 2023, or for anything else that cannot lawfully be limited or excluded under Nigerian law.

19.2 What we are not liable for

Subject to clause 19.1, we are not liable for:

  • Loss of profit, revenue, contracts, anticipated savings, business or goodwill.
  • The cost of an aircraft remaining on the ground, delayed or cancelled flights, disrupted schedules, passenger compensation, or charter or lease costs incurred while crew is found.
  • Regulatory fines, sanctions or enforcement action taken against you, including for failures in your own crew record-keeping or licence checking.
  • Any act, omission, breach or insolvency of an operator or a professional, including non-payment of a professional by an operator.
  • Any decision made about an engagement, by either side.
  • Loss or corruption of data, except to the extent caused by our breach of clause 14 of the Privacy Policy.
  • Anything indirect or consequential, however it arises.

19.3 The cap

Subject to clause 19.1, our total liability to you for all claims arising in any twelve month period, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of:

  • the total fees you paid us in the twelve months before the event giving rise to the claim; and
  • ₦250,000.

Because Crewbase is free for professionals, a professional’s claim will normally be capped at ₦250,000. This is a deliberate allocation of risk that reflects what we charge, and the price of the service is set on the basis of it.

19.4 Time limit

Any claim must be brought within twelve months of the date you became aware, or should reasonably have become aware, of the circumstances giving rise to it, except where a longer period is required by law.

20Indemnity

You will indemnify us against any claim, loss, liability, fine or reasonable cost (including legal fees) that we suffer arising from:

  • your breach of these terms or of any law in connection with your use of Crewbase;
  • anything you upload or post, including a credential that is not yours or has been altered;
  • your use of a professional’s contact details, or of any personal data you obtained through Crewbase;
  • for operators, any engagement you enter into and any claim brought by a professional in connection with it, including claims about pay, status or conditions; and
  • for professionals, any claim that you were not free to accept work you declared yourself free to accept.

We will tell you promptly of any claim we intend to pass on to you, let you take conduct of the defence where it is reasonable to do so, and not settle without your agreement, which you will not unreasonably withhold. This indemnity does not apply to the extent the claim was caused by our own breach.

21Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria.

If we disagree, we resolve it in this order:

  • Talk to us first. Send the details to legal@crewbase.africa. We will respond within 14 days, and both sides will negotiate in good faith for 30 days from that notice. Most things end here.
  • Mediation. If negotiation fails, the dispute goes to mediation at the Lagos Multi-Door Courthouse, with the mediator agreed between us or appointed by the Courthouse. Each side bears its own costs and we share the mediator’s fee.
  • Arbitration. If mediation fails within 60 days of it starting, the dispute is finally resolved by arbitration under the Arbitration and Mediation Act 2023, before a single arbitrator, seated in Lagos, in English. The award is final and binding and may be enforced in any court of competent jurisdiction. If we cannot agree on the arbitrator within 21 days, either side may ask the Chartered Institute of Arbitrators (Nigeria Branch) to appoint one.

Two things sit outside that ladder, and they matter:

  • Either of us may go straight to a Nigerian court for urgent injunctive relief — for example to stop a data breach or the misuse of contact details spreading.
  • You may complain to the Nigeria Data Protection Commission about data handling, or to the Federal Competition and Consumer Protection Commission as a consumer, at any time. Nothing in this clause requires you to arbitrate first, and nothing in it takes away a statutory right or remedy.

Claims are brought individually. Neither of us will bring a claim as a representative of a class of other users.

22Force majeure

Neither of us is liable for failing to perform because of something beyond our reasonable control — including power or network failure, failure of a telecommunications or cloud provider, cyber attack, act of government or regulator, civil unrest, industrial action, epidemic, fire or flood. The obligation is suspended while the event lasts. If it lasts more than 30 days, either of us may terminate and we will refund fees paid for service not delivered.

23Changes to these terms

We may update these terms as the product and the law change. For material changes we will give at least 30 days’ notice by email to the address on your account, and show the change in the app before it takes effect. Continuing to use Crewbase after that date means you accept the new terms; if you do not, cancel before it and we will refund any unused paid period.

Minor corrections take effect on publication. The version and date at the top of this page always tell you which version is in force, and we keep prior versions on request.

24General

  • Entire agreement. These terms and the Privacy Policy are the whole agreement between us about Crewbase, and replace anything said beforehand. Neither of us relies on any statement not written here — but this does not limit liability for fraud.
  • Severability. If any part is held unenforceable, it is modified to the minimum extent needed to make it enforceable, or removed; the rest stands.
  • No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.
  • Assignment. You may not transfer your rights under these terms without our written consent. We may transfer ours to a group company or to a buyer of the business, provided your rights are not reduced.
  • Notices. We write to the email address on your account; you write to legal@crewbase.africa. Email notice is treated as received the next working day.
  • Third parties. Nobody other than you and us has any right to enforce these terms.
  • Language. These terms are in English, and English governs their interpretation.
